Class Action - Jean-François Carpentier vs. Apple Canada Inc.
The Petitioner has filed a Motion in Superior Court for authorization to institute a Class Action against Apple Canada Inc. ("APPLE"). This class action lawsuit affects all Quebec residents who purchased an IPOD NANO as of its introduction into the market in September 2005 and thereafter.
The Petitioner seeks, among other damages, the complete reimbursement of the purchase price of his IPOD NANO due to the fact that the screen scratches to such an excessive extent, in such a short period of time after purchase, despite a normal use of the product, rendering it unfit for the use for which it was intended. It is alleged that considering the substantial purchase price of the IPOD NANO, the suggested use by APPLE and its own representations, such a screen should not scratch to this extent in so little time after its purchase.
