 | Honda Canada Inc.
Petitioner, Mr. Marcoux, has instituted in the Superior Court of Quebec a motion for authorization to institute a class action against the automobile manufacturer Honda Canada Inc. This proceeding concerns the following vehicle models: Honda Accord Coupé 1997, 1998 and 1999; Honda Accord Sedan 1997, 1998 and 1999; Honda Civic Hatchback 1998, 1999 and 2000; Honda Civic Sedan 1998, 1999 and 2000; Honda CR-V 1997, 1998 and 1999; Honda Odyssey 1997, 1998. 1999; Honda Prelude 1997, 1998 and 1999; Acura CL 1997, 1998, 1999; Acura EL 1998, 1999, 2000 and; Acura TL 1999.
Mr. Marcoux seeked to be reimbursed for the costs he had to pay following a notice of safety recall for those who had or will have to disburse sums of money to have their vehicle's ignition starter switch replaced.
This notice mentioned that the safety recall was due to a manufacturing defect caused by Honda Canada. Despite this, Honda Canada charged costs in order to carry out this replacement for all vehicles equipped with a remote starter, an alarm system and/or an antitheft system installed after their initial roll-out from the factory.
It is estimated that more than 23,500 people are in the same situation as Mr. Marcoux.
The Motion was heard on July 22, 2005, and the honourable Justice Diane Marcelin of the Superior Court, authorized the Class Action by judgment.
In conformity with the said judgment, a Notice was published in the newspapers and the Class Action has been instituted. A trial was scheduled to take place beginning May 5, 2008, but the parties came to an Agreement just prior to the commencement of the trial.
This agreement is subject to the Court's approval before the agreement can be executed and a hearing to this effect has been fixed for July 3, 2008 at the Montreal Courthouse (see the Judgement).
On July 3, 2008, the Honourable Justice Diane Marcelin, j.s.c, approved the Agreement which is now binding and executory.
According to the Agreement, the group members who file a claim within the requested delay (being October 31, 2008) will receive the least of $37.50 (representing more than 90% of the average value of the cost of reinstallation of the after sale accessories) or the amount actually paid (including the taxes). A Notice which included the claim form has been sent by mail to every person that received the Notice of Recall.
