Class Action –vs- Joseph Élie Ltée
On April 2, 2009, the Honourable Mark G. Peacock, J.S.C. will be asked to approve a settlement of a Class Action that Kugler Kandestin has been handling against Joseph Élie Ltée.
The Class Action was instituted on behalf of customers of Joseph Élie Ltée who we alleged had paid for heating oil that was not actually delivered. Two independent contractors who were responsible for delivering heating oil to customers of Joseph Élie Ltée were accused of and pleaded guilty to diverting a certain volume of heating oil away from the customers' oil tanks during the period from January 5, 2006 to March 27, 2007.
