Class Action Scarola -vs- Shell Canada Limited

On July 7, 2003, the honourable Justice Claude Tellier of the Superior Court has authorized the institution of a Class Action against Shell Canada Limited on behalf of all owners or leaseholders of vehicles in which bronze Shell gas had been put in since March 1st, 2001 (see the Judgment - Acrobat format, 1.4MB, as well as an English version of the Notice to the Members - 712KB, both in PDF/Acrobat format) .

On July 12th, 2004, the Honourable Mr. Justice Benoît Emery, J.S.C. approved the Settlement in this file (see the Judgement).

A Legal Notice will be published in major newspapers of the Province of Quebec on two (2) consecutive Saturdays, July 31st and August 7th, 2004, giving the details of the Settlement and the claims related hereto.

TAKE NOTICE OF THE DELAYS:
  • To opt out: Members who wish to opt out from the class action will benefit from a 90-day delay from the date of the publication of the second legal notice (that is: the notice published on August 7th, 2004) by mailing or otherwise remitting to Shell an opt out form duly signed, failing which the member will be bound by the terms of the Settlement. Any class member who opts out of the Settlement will not be entitled to any of the benefits or relief set out in this Settlement Agreement and, consequently, will have to institute his/her own legal proceedings.
  • Inspection: Members who wish to claim for the inspection will benefit from a 30-day delay from the date of the publication of the second notice (that is: the notice published on August 7th, 2004) to mail or otherwise remit to Shell a registration form for inspection. These members will have the opportunity to modify his/her choice later on in order to benefit from another kind of compensation under the Settlement.
  • Expenses and Vouchers: Members who wish to be reimbursed for their Expenses or wish to receive Vouchers will have a 90-day delay from the date of the publication of the second notice (that is: the notice published on August 7th, 2004) to mail or otherwise remit to Shell the appropriate claim form as well as all other documents requested by the Settlement.

    The aforementioned information is a summary of the important delays in connection with the claims’ process. Please note that this summary is provided for information purposes only and does not supersede the contents of the Settlement which remain the only official text.
You may now proceed with the preparation and sending of your claim forms as well as the requested documentation to Shell and we invite you to do so without delay. These forms are available below.

In virtue of the Settlement, Shell will set up a fully staffed Claims’ centre to help the members in regard to the various categories and options.

This centre should be operational by no later than July 31st, 2004. Members will then be able to contact the centre at the following phone number: 1 (866) 691-2697. Members may also consult Shell’s Web site at the following address: www.shell.ca, for more details.

The final claim forms will be available to the members commencing July 31st, 2004 and members will be able to consult and obtain the forms by contacting Shell in the above-mentioned manner or in consulting our Web site.
