Sony Class Action

The Petitioner has filed a Amended Motion in Superior Court for authorization to institute a Class Action against SONY. L'Union des consommateurs also confirmed their intention to joint the Class Action. This class action lawsuit affects all people who purchased one or more copy protected compact discs containing SONY'S XCP and MEDIAMAX as of their introduction into the market.

Following the filing of this motion, negotiations took place and a tentative settlement agreement was reached between the Petitioner and the Respondents, which agreement includes several other proceedings instituted afterwards across Canada. The approval hearing for this proposed transaction took place on September 28, 2006 and was approved by the Honourable Justice Paul G. Chaput on October 4, 2006, as per the terms of the Notice and the Judgment attached herewith. The list of CDs contemplated by the settlement can be found under Annex A of the transaction.

IMPORTANT UPDATE: ADDITIONAL BENEFITS ARE NOW AVAILABLE TO CLASS MEMBERS. AMONG THEM, THE DELAY TO FILE A CLAIM HAS BEEN EXTENDED TO DECEMBER 31, 2007. CLAIM FORMS ARE AVAILABLE ON THE WEBSITE http://cdtechsettlement.sonybmg.ca. MORE DETAILS EXPLAINING THESE ADDITIONAL BENEFITS WILL BE POSTED SHORTLY.
